01.Acceptance of Terms

These Terms & Conditions ("Terms") govern your access to and use of the Lolo Everglow website (the "Site") and your purchase of any products offered through it. By browsing the Site, creating an account, or placing an order, you confirm that you have read, understood, and agree to be bound by these Terms, together with our Privacy Policy and Shipping & Refunds Policy.

If you do not agree with any part of these Terms, please do not use the Site or purchase our products. You must be at least 18 years of age, or the age of legal majority in your jurisdiction, to place an order.

02.Our Products

Lolo Everglow offers handpoured candles made with natural coconut wax, room & body sprays, car diffusers, and related home fragrance products. Because every item is handmade in small batches, you may notice slight variations in color, texture, scent intensity, or finish between products. These variations are a natural characteristic of handcrafted goods and are not considered defects.

We make every effort to display our products as accurately as possible. However, colors and appearance may vary depending on your screen or device, and scent perception is subjective. Product weights (e.g., 8 oz / 227 g) are approximate fill weights.

All products are subject to availability. We reserve the right to limit quantities, discontinue any product, or modify product specifications at any time without notice.

03.Orders & Payment

Placing an Order

When you place an order, you are making an offer to purchase. We reserve the right to accept or decline any order for any reason, including suspected fraud, pricing or listing errors, or stock unavailability. Your order is accepted only when we send you an order confirmation.

Pricing

All prices are listed in U.S. dollars (USD) and are exclusive of applicable taxes and shipping charges, which are calculated at checkout. We work hard to keep pricing accurate, but if a product is listed at an incorrect price due to an error, we may cancel the order and refund any amount charged.

Payment

Payment is due in full at the time of purchase. We accept the payment methods displayed at checkout. By submitting payment information, you represent that you are authorized to use the payment method provided.

04.Shipping & Delivery

We ship to the addresses provided at checkout. Processing times, shipping methods, estimated delivery windows, and shipping charges are described in our Shipping & Refunds Policy.

Estimated delivery dates are provided as a guide only. Once a package is handed to the carrier, delivery timing is outside of our control, and we are not responsible for delays caused by carriers, weather, customs, or other events beyond our reasonable control.

Risk of loss and title for products pass to you upon our delivery of the products to the carrier. Please ensure your shipping address is accurate — we are not responsible for orders shipped to an incorrectly entered address.

05.Returns & Refunds

We want you to love your Lolo Everglow order. If something isn't right, our return and refund process — including eligibility windows, condition requirements, and how to start a return — is set out in our Shipping & Refunds Policy, which forms part of these Terms.

For hygiene and safety reasons, certain items (such as used candles, opened sprays, or opened diffusers) may not be eligible for return unless they arrived damaged or defective. If your order arrives damaged, please contact us within 48 hours of delivery with photos of the product and packaging so we can make it right.

06.Product Use & Safety

Our products are intended for home fragrance use only and must be used according to the instructions and warning labels included with each product. You are responsible for using our products safely.

To the fullest extent permitted by law, we are not liable for injury, loss, or damage arising from misuse of our products or failure to follow the provided safety instructions. For more guidance, see our Candle Care Guide.

07.Intellectual Property

All content on the Site — including the Lolo Everglow name, logo, "Tropical Scents" tagline, product names, photography, graphics, text, and design — is owned by or licensed to Lolo Everglow and is protected by copyright, trademark, and other intellectual property laws.

You may not copy, reproduce, distribute, modify, republish, or create derivative works from any content on the Site without our prior written permission. Nothing in these Terms grants you any license or right to use our trademarks or branding.

08.Acceptable Use

When using the Site, you agree not to:

• Use the Site for any unlawful purpose or in violation of these Terms;
• Attempt to gain unauthorized access to the Site, other accounts, or our systems;
• Interfere with or disrupt the Site's operation, including introducing malware or harmful code;
• Scrape, harvest, or collect information from the Site by automated means;
• Impersonate any person or misrepresent your affiliation with any person or entity;
• Submit false, misleading, or fraudulent information, including fraudulent orders or chargebacks.

We reserve the right to refuse service, cancel orders, or restrict access to the Site to anyone who violates these Terms.

09.Disclaimers

The Site and all products are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Lolo Everglow disclaims all warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components, or that any defects will be corrected. Scent descriptions are provided for guidance only and individual experience may vary.

10.Limitation of Liability

To the fullest extent permitted by law, Lolo Everglow, its owners, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising out of or relating to your use of the Site or products, even if we have been advised of the possibility of such damages.

In no event will our total liability to you for all claims arising out of or relating to these Terms or your purchase exceed the amount you paid to us for the product(s) giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

11.Indemnification

You agree to indemnify, defend, and hold harmless Lolo Everglow and its owners, employees, and partners from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your breach of these Terms, your misuse of the Site or products, or your violation of any law or the rights of a third party.

12.Governing Law

These Terms and any dispute arising out of or relating to them or your use of the Site are governed by the laws of the state in which Lolo Everglow operates, without regard to its conflict of law principles. Any disputes will be resolved in the courts located in that state, and you consent to the personal jurisdiction of such courts.

We may update these Terms from time to time to reflect changes in our products, practices, or legal requirements. The "Last Updated" date at the top of this page indicates when these Terms were most recently revised.
